Terms of service

These terms govern your use of Nusan at nusan.uk. Nusan is a product of dijitul, a UK web agency. By creating an account, starting a trial or using the free check, you agree to these terms. If you do not agree, please do not use the service. Our full registered details are set out in our privacy notice.

1. What Nusan does

Nusan monitors whether AI assistants name your business when they are asked buying questions about your category and area. We generate questions from the business profile you supply, send those questions to the published interfaces of OpenAI, Anthropic, Google and Perplexity, record the answers, detect competitor names in them and produce a score and a history you can track over time.

2. Accuracy, and what Nusan does not promise

Nusan produces a directional index, not a measurement of truth. Please read this section carefully, because it describes the single most important limitation of the service.

  • Results are derived from answers returned by third-party AI provider interfaces at the moment we ask. Those models are probabilistic. Asking the same question twice can produce different answers, so scores move for reasons that have nothing to do with your business.
  • Answers returned to us through a provider interface will differ from what a member of the public sees in a consumer AI app. The consumer apps apply their own system instructions, personalisation, stored memory of the user, location signals, live web browsing and their own retrieval and ranking layers. We control none of that and cannot reproduce it.
  • Provider models, versions and behaviour change without notice. A change on their side can shift your score with no change on yours.
  • Competitor detection is automated text matching. It can miss a mention or record one in error, particularly where business names are generic or shared.
  • Nusan does not guarantee that you will be named by any AI assistant, that your score will rise, that you will gain visibility, enquiries, customers or revenue, or that any recommendation we make will produce a particular outcome. We do not control the AI providers and we have no ability to influence their answers.

Use Nusan as a trend indicator and a prompt for action. Do not use it as the sole basis for a significant commercial decision, and do not present its output to third parties as a definitive statement of how AI assistants behave.

3. Eligibility and your account

You must be at least 18 and, if you are signing up for a business, you must have authority to bind that business. You are responsible for keeping your password secure, for everything done under your account, and for making sure the business details you enter are accurate and that you are entitled to submit them. Tell us at hello@nusan.uk immediately if you think your account has been accessed by someone else.

4. Free trial

New accounts get a 14-day free trial. No card is required to start it. During the trial you have access to the plan features described at sign-up, subject to any fair use limits shown in the app. We may end or shorten trials, or refuse a trial to anyone who has already had one, where we reasonably suspect abuse. At the end of the trial your access pauses unless you choose to subscribe. Nothing is charged automatically at the end of a trial.

5. Subscriptions, prices and payment

  • Nusan is sold as a monthly rolling subscription in pounds sterling.
  • All prices shown exclude VAT. VAT is added at the applicable rate at checkout where it is chargeable.
  • Payments are taken by Stripe through Stripe Checkout. We never see or store your card details. Your use of Stripe is also subject to Stripe's own terms.
  • Your subscription starts on the day you complete checkout and renews automatically each month on the same date until you cancel. Each renewal is charged to the payment method on file.
  • If a payment fails, Stripe will retry. If it keeps failing we may suspend access until payment succeeds.
  • We may change prices for future billing periods. We will give at least 30 days' notice by email, and you may cancel before the change takes effect.

6. Cancelling, and your 14-day cooling-off right

You can cancel at any time through the Stripe Customer Portal, reachable from your billing settings in the app. Cancellation stops future renewals. Unless a statutory right applies, cancellation takes effect at the end of the period you have already paid for, and you keep access until then.

If you are a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days from the day the contract is concluded to cancel a distance contract for services and receive a refund. To use that right, email hello@nusan.uk within 14 days, or use the Stripe Customer Portal and tell us you are cancelling under the Regulations.

When you subscribe, you ask us to start providing the service immediately rather than waiting for the 14-day period to expire, and you acknowledge the effect of that. If you then cancel within the 14 days, you remain liable for a proportionate amount reflecting the service supplied up to the point you told us you were cancelling, and we refund the balance. If the service has been fully performed within the 14 days at your express request, the cancellation right is lost. If you would rather not start immediately, do not subscribe until you are ready.

Outside the statutory cooling-off period we do not give refunds for partial months or for periods in which you did not use the service.

7. Acceptable use

You must not:

  • enter business details you have no right to use, or impersonate another business;
  • enter personal data about other people, or any special category data, into your business profile or the free check;
  • use Nusan to harass, defame or mislead anyone, including by misrepresenting our output as a definitive ranking;
  • attempt to break, overload, probe or circumvent the service, its rate limits or its authentication;
  • scrape, resell, sublicense or white-label Nusan output as your own product without a written agreement with us;
  • use Nusan in a way that breaches the terms of OpenAI, Anthropic, Google, Perplexity or Stripe, or that puts our access to those services at risk;
  • use automated means to create accounts or repeatedly claim free trials;
  • use the service unlawfully or in breach of any applicable regulation.

We may suspend or close an account that breaches this section, and we will tell you why unless we are prevented from doing so.

8. Your content and our output

You keep ownership of the business details you submit. You grant us a licence to use, store and transmit them for the purpose of running the service, including sending them to the AI providers listed in our privacy notice, for as long as your account is open.

We own the Nusan platform, its interface, its scoring methodology, its question generation and all associated intellectual property. Your subscription grants a limited, non-exclusive, non-transferable right to use the service for your own business while your subscription is active. Reports we generate for you may be used freely inside your own business and shared with your own advisers, provided the limitations in section 2 are not misrepresented.

9. Third-party AI providers

Nusan depends on the interfaces of OpenAI, Anthropic, Google and Perplexity. If a provider changes its terms, prices, models or availability, restricts our access, or withdraws a service, we may change or remove the corresponding coverage in Nusan. We will tell subscribers about material changes to coverage. Continued reduced coverage that materially affects the plan you pay for entitles you to cancel.

10. Availability and support

We aim to keep Nusan available at all times but we do not offer a guaranteed uptime figure. We may carry out maintenance, and we will try to schedule anything disruptive outside UK business hours. Scans may be delayed or fail when a provider is unavailable or rate limits us, and we will retry where we reasonably can.

11. Suspension and termination

You may close your account at any time. We may suspend or terminate your account on reasonable notice, or immediately where you have materially breached these terms, where we are required to by law, or where your use threatens the security or stability of the service. On termination your right to use Nusan ends, and we delete or anonymise your data as described in our privacy notice. Sections that by their nature should survive termination will do so.

12. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. In particular, nothing here affects your statutory rights as a consumer.

If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any loss arising from your use of the service for a business purpose. Under the Consumer Rights Act 2015 the service must be supplied with reasonable care and skill, and if we fail to do so we will put it right or give you an appropriate reduction in price.

If you are a business: we exclude all implied warranties to the fullest extent permitted by law. We are not liable for loss of profit, loss of business, loss of contracts, loss of goodwill, loss of anticipated savings, loss of search or AI visibility, or any indirect or consequential loss. Our total liability to you in connection with the service, whether in contract, tort including negligence, breach of statutory duty or otherwise, is limited to the total fees you paid us in the 12 months immediately before the event giving rise to the claim.

We are not liable for the accuracy, content, availability or behaviour of the AI providers, nor for any decision you take on the basis of Nusan output, which is provided on the directional basis described in section 2.

13. Data protection

We handle personal data as set out in our privacy notice, which forms part of these terms. Where you submit personal data about other people, you confirm you are entitled to do so, though as stated above you should not do so at all.

14. Changes to these terms

We may update these terms. For changes that materially affect your rights, we will give at least 30 days' notice by email, and you may cancel before they take effect. Minor corrections take effect when published, with the date at the top updated.

15. General

  • You may not transfer your rights under these terms without our written consent. We may transfer ours if the business is sold, and your rights will be unaffected.
  • If any provision is found to be unenforceable, the rest continues to apply.
  • A delay in enforcing these terms is not a waiver of our rights.
  • Nobody other than you and us has any right to enforce these terms.

16. Complaints and governing law

Please raise any complaint at hello@nusan.uk. We aim to acknowledge within two working days and resolve within 14 days.

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
